Trading Up Promotion
Promotion Guidelines
These Guidelines describe how Entercom Seattle, LLC, d/b/a KISW (the “Station”) will conduct its Hola Switchola Trading Up Promotion.
The Promotion will begin on November 12, 2007 and will run approximately 24 days, or until an item deemed sufficiently valuable is obtained in the trading process. The goal of the Promotion is to obtain an item that will be donated to Ronald McDonald House Charities of Western Washington and Alaska so that it may be auctioned or otherwise liquidated for a meaningful dollar amount for the benefit of this charity.
The Station will begin the trading process (sometimes called switches on-air) by announcing an item in its possession (and which the Station owns), and soliciting from listeners items that they are willing to trade for it. Pictures of items offered by listeners may be submitted by via cell phone and email.
A. To submit a item via cell phone:
1. Add a Contact On Your Cell: Make a KISW contact on your cell phone and enter hola@switchola.com into email address line on your cell phone, even if you do not have email or internet on your phone.
2. Take a picture with your cell phone
3. Send the picture to the KISW contact (hola@switchola.com) and make sure to enter a the name of the item you want to switch and add a caption along with your name and city in the text part of the message.
B. If you don’t have a cell phone with a camera you can email us your photo:
1. Take a picture and email it to hola@switchola.com with your phone number as the subject line.
2. In the body of the email, please enter a title of the item you want to switch, add a caption about the picture along your name and city.
C. Wait For Your Phone To Ring.
1. Once we receive your picture, Ted Smith will call you back on your cell phone or the phone number on the subject line of your email.
2. You will be prompted to record a voice message to describe the item you want to trade. You must include your name and city.
While the Station may solicit listeners’ votes on posted items, their votes will not control the selection process. The station has absolute and sole discretion in its determination of which items it selects for trade of those offered by listeners. Once an item has been selected in trade and the exchange made, that new item will then be offered and new trading items solicited. This process will continue for approximately 18 days (8) trades, but the Station reserves the right to increase or reduce the number of trades depending on the progress of the Promotion.
The following rules will govern the trading participants and items in the Promotion:
- To participate in the trading process the “Trader” must be at least 18 years of age and legal residents of the State of Washington.
- Employees of the Station and its parents, subsidiaries, promotion sponsors, affiliated companies, advertising agencies, participating charities, any other Saettle area radio stations, and the immediate family members or household members (i.e., spouses, parents, grandparents, children, grandchildren, siblings and housemates) of each of the above are NOT allowed to participate in this Promotion.
- Traders must be the sole legal owner of the item they propose to trade, be free and authorized to give the item to the Station in trade, and in so doing will not violate any rights of any third parties.
- If a photo of an item is offered or submitted via cell phone or online, the Station may you use the Trader’s name, likeness, voice, biographical information, and, if applicable, the substance of the Trader’s telephone call for on-air broadcast, print advertising and for advertising and promotional purposes. Traders agree that no additional compensation will be paid for such usage.
- The Station has full and absolute discretion in the selection of items to be posted for consideration to be traded, and in the selection of those to be traded, and, without limitation, will not accept or entertain offers for any items that are illegal, indecent, immoral or dangerous. Offered items should be in good working order, if applicable.
- Once the Station selects an item for trade, the Trader offering the item must bring it to the Station and give it to the Station exchange for the item in trade for which it was selected.
- Each Trader whose item is selected must sign an Acknowledgement and Release in the form attached to these Guidelines before they will be given the item they traded for.
- No Trader will receive any charitable deduction or other tax benefit as result of participating in the promotion or for trading any item.
- All Traders or others participating in the Promotion hereby acknowledge and agree that they may be mocked or ridiculed by station personnel on the air in response to the description of the item(s) they have offered for trade.
The Promotion is subject to all applicable laws and is void where prohibited. The Station reserves the right to amend, modify, shorten, lengthen or terminate the Promotion at any time without notice.
